The most popular article on our Website in recent months has been Special Collection: Entrepreneurship Toolkit.  On re-reading it, the section on process stood out. It's a reminder that a defined business process saves money, reduces risk and improves return on investment (ROI). Whether it is a new venture, product or service it helps to design and test the necessary business process before obtaining legal or other advice.

Generally legal, or other advisory or consultancy work, is best done after the core business process has been defined. Designing the process in parallel involves more time and hence fees. The Flash animation below is designed to illustrate the distinction and overlap between business process and advice. It is in our detailed Needs Assessment Guide which we supply to clients to assess their processes and needs. It is one of our ways of helping clients save money, reduce risk and improve ROI. Study the Flash animation and then read on.

Why process comes before legal advice

Points to note about the above sample business process:

1.  there are 3 process stages (ie Order, Process, Delivery) and 16 process steps;

2.  the steps for legal advice are circled in red, typically they are legally-relevant documents;

3.  all steps require codification or definition. It helps to do it with both text and a graphic.

Contact us if you want a copy of our Needs Assessment Guide. It explains in more detail how the following items help save time and money by defining process before doing legal work:

1.  product graphics  (illustrates the product or service offering for better communication);

2.  product glossary  (defines key words, technical terms, jargon, and product components);

3.  product map  (links the different components, parts or elements of a product or service);

4.  product definition (describes the product and names and definitions of components); and

5.  other documentation - (eg process map, value chain, business model definition).
